By accessing or using the services provided by Falcon L&C Hosting Limited ("the Service," "we," or "us"), you agree to be bound by these Terms and Conditions ("Terms"), forming a legally binding contract between you and us. If you do not agree to these Terms, you may not access or use the Service.
The Service includes, but is not limited to, access to our Lecture Hosting Platforms (LHP), Class Hosting Platforms (CHP), and Studio Product offerings.
2.1 Our Right to Refuse Service
We reserve the absolute right to refuse any purchase of our Hosting or Studio Product offerings. Should we choose to exercise this right, we will issue a full refund of your payment and your access to the purchased product or service will be immediately terminated.
2.2 Non-Transferable Use
The subscription and associated account ("the Service") is granted exclusively to the individual or entity (You) who completes the purchase. The Service cannot be sold, sublicensed, leased, assigned, or otherwise transferred or resold to any other person, company, or individual. Your account is solely for your use as the registered subscriber. Any attempt to transfer or sell the account will result in immediate termination of the Service without refund.
2.3 Hosting Service Specifications
Unlimited Hosting Time: You can host unlimited hours of class or lectures during your active subscription.
Virtual Memory/Resources: We do not provide any extra Virtual Memory or guaranteed dedicated computational resources.
Third-Party Software: If you choose to use any 3rd party software for cloud storage or other integrated functionality, we are not responsible for its performance, data security, or technical compatibility.
3.1 Flexible Payment Plans
Monthly Subscription: Billed every 30 days at 2,500 LKR.
Annual Subscription: Billed once per year at 25,500 LKR.
All fees are stated in LKR (Sri Lankan Rupees).
4.1 120-Day Refund Guarantee
We offer a 120-day money-back guarantee on the initial purchase.
Request must be submitted via written notice within one hundred and twenty (120) calendar days of your initial purchase date.
Required Documentation: To process the refund, you must provide the appropriate bank receipt or purchasing software receipt, a screenshot of the bank account transaction, the Transaction ID, and any other valid payment information.
Refund Deadline: After the 120-day period has elapsed, any refund request will not be honored.
4.2 Subscription Cancellation
You may cancel at any time. If cancelled after the 120-day period, your subscription remains active until the end of the current billing cycle, and no partial refunds will be issued for remaining time.
5.1 Our Service Content
All software, design, text, graphics, logos, and materials provided by Falcon L&C Hosting Limited are our exclusive property and are protected by intellectual property laws.
5.2 User-Generated Content (UGC)
Ownership: You retain all intellectual property rights in the content you upload ("UGC").
License to Us: By hosting your UGC, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute the UGC only as necessary to provide and maintain the Service.
6.1 Purchasing Eligibility
To purchase the Service, you must be over 18 years of age.
6.2 Mandatory Verification
Upon request, you must provide valid, government-issued identification for verification. This includes: National Identity Card (NIC), Phone number, Driving License, Passport, Birth Certificate, or Marriage Certificate.
6.3 Security Responsibility
You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
7.1 Prohibited Content and Conduct
No inappropriate content can be showed or streamed during classes or lectures. Violation of this clause will result in immediate suspension or termination of your account without refund.
7.2 Student Well-being and Data Security Commitment
We are committed to the well-being of students.
Data Security Promise: From Falcon L&C Hosting Limited's side, we promise to keep your data safe. We commit to employing commercially reasonable safeguards to protect the data stored on our systems from unauthorized access, disclosure, alteration, or destruction.
User Privacy Responsibility: Notwithstanding our commitment to data security, you, the user/purchaser, are solely responsible for compliance with all applicable data protection and privacy laws (including, but not limited to, the collection, storage, and use of student data). Falcon L&C Hosting Limited does not maintain a separate Privacy Policy, and all liability related to student data privacy rests with the user who created the content.
7.3 Prohibited Activities
Any use of the Service for Hacking, Scamming, Phishing, or the distribution of malware will result in immediate and permanent termination without refund.
8.1 Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties, and we make no warranty that the Service will be uninterrupted, timely, secure, or error-free.
8.2 Limitation of Liability
To the fullest extent permitted by law, Falcon L&C Hosting Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use or inability to use the Service.
9.1 Governing Law
This agreement shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka.
9.2 Dispute Escalation
Disputes will be handled according to the following escalation path:
Non-Serious (Average) Disputes: Handled internally through mediation with the Company Staff.
Unresolved/Serious Disputes: Escalated for review and decision by the Company Board of Directors.
Very Serious Disputes: Disputes deemed severe, or those that violate criminal laws, will be referred to the Court and appropriate Authorities in Sri Lanka.
Criminal Cases: If a dispute involves a serious criminal offense, the matter will be immediately reported to the Police and relevant legal authorities.
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of these Terms. Your continued use of the Service after any modification constitutes acceptance of the revised Terms.
